AHMEDABAD: Famous Gujarati singer Kinjal Dave has approached Gujarat high court against an interim stay ordered by a city sessions court on her singing her smash hit ‘char char bangadi wari gadi’ following a copyright row.
Her advocate J V Vaghela said that the interim order was challenged on the ground of legality because the lower court passed the stay order without hearing her side.
The order was without reasoning and hence it should be quashed.
The lawyers representing the other side, Red Ribbon Entertainment Pvt Ltd, appeared before the court on Tuesday as they had filed a caveat. They sought a day’s time and a division bench of the high court posted hearing on the subject on Wednesday.
Earlier this month, the sessions court had restricted Dave and two music companies – the Mumbai-based RDC Media Pvt Ltd and the Junagadh-based Studio Saraswati – and their partners, agents who conduct live stage concerts from selling the album in any form till January 22. The court issued restraint orders after Red Ribbon filed a suit alleging copyright infringement on its copyrighted song claiming that it purchased rights of this song on April 18, 2017.
